Antitrust Regulation, On The Abuse Of Intellectual Property

Under the ground of the rapid development of knowledge-based economy, intellectual property is becoming more and more important in the country's economic and social development. Regulation of the abuse of intellectual property has been an important task of western antimonopoly law. With the promulgation and implementation of Chinese Antimonopoly law, the complex relationship between intellectual property and antimonopoly law increasingly draws the attention of the academics of Chinese Intellectual Property Law and Economic Law.Confronting the monopoly relying on intellectual property executed by multinational companies and the actions of restricting competition executed by domestic right holders of intellectual property, our country's competitive market order has been adversely affected because of the imperfect legal system of regulation of the intellectual property. Enforcing the research of the antimonopoly in intellectual property takes on important meaning both in theory and in practice. In this thesis, firstly, I introduce the basic theory of the abuse of intellectual property and antimonopoly law, then analyze the relationship between them, demonstrate the necessity of the regulation of intellectual property by antimonopoly law, and survey the legislative situation of developed countries. At last, I give some legislation recommendations to the field of intellectual property regulated by antimonopoly law.
