Building Restorative Justice System

As a new model of justice, restorative justice is paid more and more attention in today's society, has become a powerful driving force in the world's criminal justice reform. Restorative justice is an effective way to solve the crime problems. It emphasizes the integration for crime damage of social relations, pays attention to the interests of victims and restores the original harmony of social relations and order. Construction of the restorative justice system will greatly improve the traditional criminal justice system and judicial system reform in china.In this paper, the author first analyzes the meaning of restorative justice, the general theory of historical development, the characteristics of restorative justice and the judicial practice of Western countries. It is a foundation for the following construction of restorative justice and feasibility analysis of restorative justice. Next, the status of restorative justice in china were discussed from the positive results and the obstacles and problems of the exploration of restorative justice in China. On this basic it explains the necessity of Construction of China's resumption of the judicial system. Then, the article discusses the feasibility of building restorative justice from available and favorable conditions and social foundation in china. This section is a key part of the article. It does a sufficient basis analysis for learning advanced theory of restorative justice system.Finally, from criminal reconciliation system, the victim assistance system and community corrections system, as well as the system design and detailed implementation measures and improvement of the construction of these specific systems,the author discusses the construction of China's resumption of the judicial system. All of these specific systems are an integral part of restorative justice. so that restorative justice system and criminal justice system complement each other. Of course, the criminal reconciliation system, the victim assistance system and community corrections system are parts of restorative justice system. But with the development of the theory and practice, restorative justice will continue to improve, and promote the legal system in China.
