Along with the development of global economic integration and differences between national economic level, labor demand and supply, working conditions and treatment, the trend of migration is increasing because workers are going to other countries or regions in order to get more economic value and interest or in search of better jobs and working environment. Migrant workers full around the world labor markets and affect the development, peace and stability of the international community, countries should attach great importance to the protection of human rights of migrant workers. To this end, the United Nations adopted the Convention on Protection of All Migrant Workers and Members of Their Families Rights in 1990, The international community have also took positive measures to protect the human rights of migrant workers.As a populous developing country, on the whole, China is basically a country of origin of migrant workers rather than the destination. In the backdrop of increasing interdependence of countries and their markets, the number of Chinese workers abroad is increasing year by year. However, in practice, Chinese overseas contract workers are often discriminated against and forced to accept unfair treatment, having little or no medical or legal protection; especially the unskilled and unregistered migrant workers, who often are placed in high - risk, low-income occupations, forced to accept the jobs which is dirty, dangerous, difficult, or be refused by local workers; or have worse medical care, living environment and occupations simply because they are migrant workers, women, or children. Generally speaking, the insufficient protection of Chinese overseas migrant workers because of both domestic factors and international factors. At present, China's domestic human rights protection of overseas migrant workers was not enough, the absence of legislation, not forming a full range of management, services and protection mechanisms; international factors embodied in three areas: the destination country is not paying adequate attention to the human rights of migration workers, discrimination against immigrants of local community, the lack of widespread international collaboration and mutual assistance of countries. To this end, for the causes and problems of the human rights of overseas migrant workers, China should reform corresponding management and service systems urgently, the international community should also actively take effective measures to jointly protect the human rights of Chinese overseas migrant workers.
