On The Throwing Objects From A Height Accountability

The case of things thrown off the buildings is a special tortious case. It is a complexic person of qualified action of tort and disqualified tort action. It's appers to be a joint tort act, but it is not a joint tort act if you open his veil ,There are essential distinction between joint tort act and throwing things off building. It can be applied to the building liability ,however,there is no reasonable basis. According to the research of China and abroad, we can find that joint tort act and throwing thing off building tort act are between similar and not similar. This paper is following the puzzle above and seeking for an answer .Is it suitable to myself liability or joint liability for throwing things off building tort act?when we dig the root for asking the source. To applying myself liability , it can not find the real tortious person .Finally the loster is difficult to compensate the loss whom may be more serious, .To applying joint liability, people who occupy the building might be covered with the unrighted liability. Facing the puzzle dom, compensation liability which base on the new" tort liability law " can't solve the problem of the reasonable compensation liability basis, which can't be well compensated lost of victim, even the justice of law is difficult to achieve the goal.In the facing the puzzling problem of throwing things off building, I think it shoud be applied to shared liability in just valve compromising. There are both sides victims for throwing things off building tort act, therefor, our choices should be qualitative and clear, this kind of choices is for protecting the right of victim. This thesis will deeply analyse the person of liability , liability basis, undertaking the liability and avoiding the liability.furthermore,this thesis will analyse the legel basis of shared liability.This paper applies to shared liability in just valve compromising,which is one sort of rearching throwing things off the buildings'liability,I hope that throwing things off the building of rearching.is not stop.
