In 1988, some middle schools like the 8th middle school in Beijing took the lead in implementing the system of appointment of teacher, this experience got more broad popularization in the 1990s. The starting point that implementing system of appointment of teacher lies in : First of all, it break the drawback of teachers can not flow and offer more chances to both teachers and schools; Secondly , it can arouse the enthusiasm of teacher, improve to run a school autonomy to be enthusiasm school, improve the educational level and help playing the role of teacher fully; The system of appointment of teacher also can overcome traditional planned economic system appointment that make drawback . However, if we make deeper analysis a bit to the content and influence of the reform of the system of appointment of teacher of the middle and primary schools, we will find it is far more than the middle and primary schools' managing the reform measure, it should be put under the background of improving the society in the whole China , it must be influenced by this background too, with the development of society, current middle and primary schools system of appointment of teacher expose the expectancy of the purpose and realistic contrast more and more. Someone thinks the system of appointment of teacher of middle and primary schools of our country has been in the " plateau district ", I think one of the main reasons is to engage the teacher one of the subjects and receive potential and realistic infringement because of the legitimate rights and interests in the course of engaging as the teacher, have dampened teacher's enthusiasm for participating in this reform. So, the system of appointment of teacher will go out of "the plateau district" progressively, the protection of teacher's rights and interests should become the important respect of this reform, need to make the fulfilling of discussion and reality of the theory.In this text, I first analyzed the background of system of appointment of teacher begins promptly, exemplify teacher engage course teacher rights and interests phenomenon that encroach on , make a brief analysis to this cause, put forward under system of appointment background protecting teacher rights and interests need , construct our country teacher system that rights and interests protection on this basis: at first ,I will introduce the experience how to protecting the rights and interests of American teachers, and then I expect this experience giving some extent drawing lessons to us; Secondly , in order to solve the difficult problem because of teacher's obstacle identity ,we should define teacher's identity, make sure the legal relation between school and teacher ;in our country the legal system of appointment is not perfect , we must improve laws and regulations and rule, then, guide the implementation of the system of appointment of teacher; Moreover, because of the engagement contract is so important to both sides, I will account various questions that the contract appears in the course of implementing the system of appointment in detail , then analyze the cause and I think to pursue"collective agreement system"in our country, it engage of...
