Legal Countermeasures Research On Preventing Domesitic Garbage Pollution

With economic development and the advancement of technology, domestic garbageproduction is also increasing. China Volume of Garbage Disposal 1.18 million tons in 2000, China Volume of Garbage Disposal 1.54 million tons in 2008. As domestic garbage become the focus of attention,many cities will face siege predicament. because domestic garbage contains a variety of pollution composition, under certain conditions which will produce biological, chemical and physical transformation, and the surrounding environment produces certain effect. If disposed of improperly, it may pollute the environment, endanger human health, more serious problem is caused by a dangerous occurrence. On the other hand, domestic garbage contains many useful substances and resources.if properly treated wit, it can save resources, reduce pollution. Therefore a reasonable recovery of waste disposal of life to reduce pollution and conserve resources is important.Because of our solid waste pollution prevention and control is still in the initial stage, domestic garbage pollution is relatively serious. At present our domestic garbage yield increansing,pollution is serious,resource recovery rate is low.Domestic garbage pollution prevention is a systematicand comprehensive neengineering ,which needs technology, policies, laws and regulations management worke togather.But laws and regulations and relevant legal system which guide the living domestic garbage pollution prevention has other means incomparable role. Perfect law and legal system can be explicitly stipulated in the relevant subject rights, obligations and responsibilities .The requirements of the relevant standards to protect living garbage pollution prevention have mandatory role. So perfect law and legal system play an important role. to guide domestic garbage pollution control .With the emphasis on solid waste pollution, China has developed "Solid Waste Pollution Prevention Law, ""Circular Economy Promotion Law of the People's Republic","municipal solid waste management methods "and"renewable resource recycling and management practices"and other laws. These laws and regulations have played an important role in protecting the environment and promoting recycling garbage disposal. But the current regulations and the legal system in China there are still some shortcomings, the difficulties garbage classification purposes, public participation is not comprehensive enough, packaging pollution is serious, extended producer responsibility is not fully established and so on. And the relevant legal system is not perfect in China compared to the United States, Japan, Germany, a relatively complete legal system related. Developed countries to improve waste separation and recovery system, the system of extended producer responsibility, environmental deposit system, public participation in the system, so that these countries continue to reduce waste production, resource recovery rate continues to increase. Therefore, to improve the status of solid waste pollution, should be combined with their actual situation, learn from developed countries to improve the legal system, improve solid waste pollution control in China's legal system. View of the solid waste resource utilization is not high status of the implementation of waste classification system should be clear criteria for waste classification. Packaging waste in China is a very important part of the packaging should be perfecting the relevant laws and regulations, reduce the amount of waste packaging, thus reducing waste production. Solid waste and people's lives, public participation is essential in the important waste management system.
