Study On Practical And Legislative Issues In Emission Trading Of Taihu Lake Basin

Emission trading is a means of economic stimulus. It is also a hotissue in the current researching about the environmental law. In the area ofChina's Taihu Lake Basin, a pilot project of emission trading has begun,which has obtained the highly successful. There are890companies joiningin the pilot project and the amount of emission trading is about1.49billionRMB Yuan since2007(when the Emission Trading Center was found inJiaxing) to2009in Jiaxing, Zhejiang. Meanwhile1.41billion RMB Yuanworth of pollution discharge rights have been sold to915companies duringlast two years in Jiangsu. For several years, the pilot project of emissiontrading has obtained certain result, but has also met some questions whichurgently wait to be solved. The construction of the relations and standardsof the emission trading system, and the coordination between the emissiontrading system and the other relation systems are especially important. Inthe practice of emission trading, there are still a lot of problems just like theconvergence of existing systems and laws, establishing the Taihu LakeBasin unified market of pollution discharge rights and the activation of thesecondary market need to be solved. On the legislative front, the absence ofnational legislation, lack of coordination of local legislation and the laggingof systematic regulations are the main problems. As an economic stimulateof Taihu Lake Water Pollution Prevention and Control, emissions tradingsystem needs legal regulation. A complete legal regulation system ofemission trading in Taihu Lake basin include not only laws whichformulates by National People's Congress and the standing committee, butalso the administrative rules and regulations, the department rules andregulations as well as the matching specifications. The legal regulationsystem of emission trading in Taihu Lake basin has not yet completelyestablished. The emission trading in Taihu Lake basin can operated stably only in a complete and also reasonable legal regulation system. How toovercome the in sufficiency as well as perfect the legal regulation system ofemission trading in Taihu Lake basin has already aroused our attention. Thescholars have carried on the multiple perspectives, the multi-level research;also put forward many constructive proposals. In order to ensure theoperation of the institutional system to achieve the purpose of pollutioncontrol in Taihu Lake, China should actively promote the "Regulations ofEmission Trading" strengthen the legislation between differentadministrative regions in Taihu Lake Basin, and improve the matchingspecifications as soon as possible.
