| As the deepening of the reform of medical system, the continuous development of medical and health services, however, the conflicts between doctors and patients become more critical gradually, and medical tangles emerge in endlessly; there are even many mass incidents and incidents of violence caused by medical tangle-commonly called "medical trouble". "Medical trouble" disturbs normal medical order and social stability seriously, and even forms unhealth claim ethos, which are opposite to the Chinese main strain social atmosphere, that is constructing harmonious society positively.According to the situation of medical trouble, there are several characteristics including large numbers, high incidence; covering various departments, having diverse forms; related to several reasons; serious cases of violence; main solution is indemnity, so economic purpose become more and more obvious; finally causing negative social influence. The phenomenon influences the social harmony and stability of our country and prevents the positive development of medical and health services on a large degree. As a result, how to remit medical tangle, how to eliminate medical trouble radically becomes the focus of the whole society.Medical troubles are caused by various reasons, involving iatrogenic reasons and non-iatrogenic reasons. Iatrogenic reasons can be divided into reasons related and unrelated to medical technology. Non-iatrogenic reasons include social reasons and institutional reasons. This article chooses the institutional reasons of non-iatrogenic reasons for further research, maintaining that the radical method to resolve medical trouble and alleviate medical tangle is to construct complete institution guiding patients to protect their rights rationally. Nowadays, the construction of medical trouble institution is incomplete, which directly results in the phenomenon that patients hardly strictly observe the law. So we need to find deficits, which can lead patients give up to protect their rights from current institution, then improve and complete the resolvent institution of medical tangle according to our national conditions.The article, first of all, reviews the current research towards medical tangles, based on the review, summarizes the current conditions of medical trouble; and analyzes, explain, and define the concept of medical tangle and medical trouble by clarifying the differences and similarities between medical tangle and medical trouble as the preparation for further discussion. Then we compare and analyze two completely different cases of typical medical trouble, to trigger the deep thinking of the bias of medical tangle institution, raising some institutional problems involving in the process to solve medical tangle. Furthermore, in order to analyze the negative influence on patients'behavior caused by current medical tangle institution.article deeply analyzes the problems underling institution related to medical tangle from three sides:they are the dual pattern of laws and regulations related to medical tangle, the lack of special laws towards medical tangle and the deficiency of the institution to solve the medical tangle, and the preference and bias of government. Finally, based on all the thorough analysis towards medical tangle institution, raise methods and solutions to complete the construction of laws and regulations, to improve the verification and indemnity institutions, to perfect the dispute resolution related to medical trouble, to strengthen the construction of government function. |
