On People's Mediation Thought By Xie Juezai-from 1937 To 1950 In Shanxi-Gansu-Ningxia Border Region

As a proletarian revolutionary of the older generation of Chinese Communist, Xie Juezai is also the forerunner of China's law circle as well as one of the founders of people's judicial system. His thought on people's mediation, the production of various factors from Shanxi-Gansu-Ningxia Border Region, is a theoretical sum-up and sublimation of the people's mediation work, which has come into being during the Second Revolutionary War, leading by Chinese Communist, and in return has profound influence on social construction in Shanxi-Gansu-Ningxia Border Region at that time.This paper systematically probes into Xie Juezai's thought on people's mediation, which can be divided into introduction, body and conclusion. Of the body there are four parts. The first part introduces the political background, real impetus and practical basis are included. The second part describes the main content of his thought, including the form and principles of people's mediation. The characteristics of his thought are analyzed in the third part, while the influence on social construction in Shanxi-Gansu-Ningxia Border Region in the fourth part.Since Xie Juezai's thought on people's mediation is a masterly summation of the government's mediation work in Shanxi-Gansu-Ningxia Border Region, systematic research on his people's mediation thought, will not only assist people in understanding the government's work attitude and direction in that region from a side view, but also provide historical reference for the legislation on and prictice of the people's mediation.
