The International Criminal Court is endowed with the mission to adjudicate individuals other than states, and to investigate the most serious crimes of international concern. It is the most significant event in the history of international criminal realm.However, the attempt to establish a criminal court among countries is not an easy mission for the world to finish."Rome Statute of the International Criminal Court"is the foundation of International Criminal Court, although it is signed to enter into force in 2003,but like America, China ,the members of the United Nations Security Council, do not sign the Rome Statute. That is not only because their serious consideration on the transference of sovereignty to the International Criminal Court, it is also because the Rome statute itself has its problems that may not get advantages in a short period of time. The problems include the jurisdiction problem, the relationship between the International Criminal Court and the UN Security Council, the right of the procurator of the International Criminal Court, and the expansivity of the whole Rome Statute. Through discussions over these issues, the article hopes to provide a better understanding of the meaning and application of the Rome Statute.
