Of Organized Crimes Legislative Defects And Improvement

The study on organized crime is a key project which criminal jurisprudence field researches today. Currently, China has been increasing blow strength ceaselessly and carrying out special campaign of Crime crackdown nation-wide. However, if we want to study out striking counter-measures on organized crime fundamentally, we must analyze clearly what causes organized crime. When organized crime is not a regional issue of a country but has existed widespread in the world, affected the society and economic safety of all the countries and even showed a transnational trend, the progress of the theory and practice of fighting against organized crime has should be an important issue related to development. By the comprehensive comparison of foreign theory of organized crime formation with Chinese scholars'theory, the article, which is based on the analysis and research on our existing organized crime legislation, analyzes and clarifies the causes of organized crime at the current stage in China and also analyzes the defects of legislative level and legal obstacles so as to set up the foundation of further perfecting the legislation of our country.
