The Legal System Of China's Low-carbon Urban Construction In The Context Of Climate Change Research

City is the center of social and economical activities, in the same time, which accounts for over a half percent in the consumption of energy. It is our strategic measure that we develop low carbon city when we are faced with the crisis of climate change. Many cities have started to develop low carbon city planning. And some scholars also have done some research in the area of development of low carbon city, focusing on the development model from economical, technological and other perspectives. Low carbon city is a new concept in recent years, resulting from the seeking for a new development model of the world in the background of the need of reducing the emission of CO2.According to the research of scholars in this area, we can find that the research is limited in the micro-economy, sustainable development, financial mechanism and high technology, but seldom mentions the legal system and legislation. Thus, this article mainly explains key mechanisms of low carbon city and how to build a low-carbon legal system in city, with the aim to promote low carbon city to run orderly and efficiently.This study focuses on the low carbon city, pursuing low carbon economy development model, and tries to build key legal mechanisms and system with Chinese characteristics through drawing lessons from other countries' practices.This article mainly includes the following key points:1.Analysis and summary of the development method of the low carbon city.2.The article promotes some legal principles of legislation after analyzing the jurisprudential background of the development of the low carbon city and explaining the necessity and importance of the development of the low carbon city from the legal function prospective.3.The article suggests key legal mechanism including the changes of energy law, carbon finance and carbon trading mechanism, and consuming policies of citizens.4. Given the above analyzing, this article also put forward a low carbon city legislation system, combined at a central level and local level.The main innovative point in this article is to design the mechanism and legal system of the low carbon city through studying the theoretical and practical issues in this area from the legal perspective.
