Legal Protection Of Biological Genetic Resources

<Convention on Biological Diversity> is signed and passed in 1992, representing the biological material is completely developing. What's more, people attach more and more importance to function and value of traditional knowledge and genetic resources.There are many cases about traditional knowledge and genetic resources in practise, so many coutries in the whole world begin to discuss the concrete measures to protect their own traditional knowledge and genetic resources.To face this situation, China increase the duty of disclosure about genetic resources in its patent law as a big developing country.From here, the international forum see this regulation as an important international problem and international coordination in patent system,discussing the duty of disclosure about genetic resources several times in international conferences. This paper introduce concept of biological genetic resources and reasons why Chinese laws protect these resources under the background modifmg for the third time about patent law, then writer elaborate three kinds of legal methods to protect biological genetic resources and emphasize the duty of disclosure about genetic resources which is added in the third modified patent law. At last, writer analyze the problems of existing protection of biological genetic resources and find the better ways to improve our laws, in order to explicit intenational protection of biological genetic resources and put forward a diligent direction for future lawmaking administration.
