Research On Improving The Severe Employment Injury Insurance's Benfit Level Of Chinese Labor Intensive

Work Injury Insurance, a core of worker's compensation, is built for protecting the basic livelihood of employees and the rehabilitation of the future, and then to maintain social harmony. Regulation on Work Injury Insurance which became effective on January 1,2004, (promulgated by the State Council on April 27,2003), marked the process of workers' compensation has officially entered the legal system. It was brought in line with foreign standards Work Injury Insurance system, and even made a large breakthrough with The Trial Procedures for Industrial Injury Insurance for Enterprise Employees. China is a labor-intensive country with a lower price of labor power. China also has other characteristics of labor groups. The labors with low level of knowledge are more than it in other countries. The main source of their livelihood is their work ability. In addition, China has a large surplus of labor resources and insufficient capital. The formulation of reform policies and measures tend to insufficient capital, and the policy support of the government is increasing, but the long-term labor resources maintain a relatively low level. In this economic condition, the growth of the total wage rate is slower than it of the enterprises'economic performance, the growth of workers' actual average wage is slower than it of productivity of labor. These led to the low wages level of labor-intensive industry and the income distribution account for the low proportion of the primary distribution and even tend to fall down. Resident income accounts for the low proportion of the distribution of national income and also tends to fall down. These are all the main causations that caused low cardinality of the compensation in workers' compensation and less compensation payment.The work injury accidents will lead to serious impact on both their lives and their minds. The severe work injury accidents will cause bad influence on their recovery and normal life in the future. There is no integral system in current employment injury insurance about compensating injury personnel. As a result of this, we know that the current pay level to severe injury personnel in labor-intensive industry is on the low side. This paper identifies the problem and makes analysis at this point. Concerning the interest rate, increasing GDP, inflation rate, accurate rate and wage level, price level, the paper discounts the income of injury personnel according to payment formula in work injury insurance regulations, combining their cost of living and recovery. It also calculates the value of the current pay level to severe injury personnel in labor-intensive industry. Comparing this value with the average wage of the injury personnel the previous year, we come to a conclusion that the current pay level to severe injury personnel in labor-intensive industry is on the low side. There are many problems in current employment injury insurance:because of the severe damage of body health and increasing age, their production capability steps down to a lower level, which reduce their life quality. Some of them even can not work and then have become social vulnerable group. These people have weak resistibility when they come under social risk attack. According to this, it is distinctly important to improve the current pay level to severe injury personnel in labor-intensive industry. Meanwhile, through the investigating and analyzing the pay level to severe injury personnel in the wood-processing industry in Hebei Province, the paper summarizes the standard pay level to severe injury personnel and find out existing problems. It is of great significance to improve work injury pay level in a targeted way, overcome the difficulties caused by word injury in labor-intensive industry, and practically improve the living and recovery actuality of severe injury personnel in labor-intensive industry.This paper also combined some successful experience of rehabilitation centers in Guangdong, compared with some more mature foreign injury insurance in some other countries. In the special circumstances of China's current conditions, the paper will focus on analysis the works'injury of the labor-intensive industries. Add some more rehabilitation money to the work injury insurance of the labor-intensive industry to longer the injured works life. This paper will combine with the foreign excellent rehabilitation measures to improve the therapeutic effect of injury rehabilitation, and consider raising the level of labor-intensive industries as a supplementary benefit factor.
