| Family is the cell of society, and the couple's property is the material basis to constitute a family. The main function of marital property relation is to undertake property and marital status. Marital property system, also known as marital property regime, refers to relevant system relating to the contents of the marital property relation in the laws relating.①With the reform and opening up and the gradual deepening of the market economy in China, the system relating to adjustment of the couple's external property in China's marital property system has become one of the important laws in connection with security of market transactions. Although Marriage Law enacted in China in 2001 is big progress, with development of social economy and culture, some contents of the law have already hindered the development of society, but need to be improved.
