| Along with the continuous deepening of reform and open policy, China's telecommunications industry has been developed rapidly. However, because of setting up under the planned economy system, the regulation of telecommunication market are faced with many obstacles that make it difficult to the telecom industry in recent development. The telecommunication industry went through a new reorganization in 2009, the telecommunication market competition changed from the disorder to order, from administrative monopoly to open market. During this critical period, it is urgent need for government to carry on the reform on the telecommunication market supervision that seeking an appropriate supervision pattern apply to China's development of telecommunications industry.First of all, in the author's opinion, due to the imperfectness of legislation, conflict of government supervision function, unreasonable of supervisory board, particularity of regulation targets and imperfection of regulatory mechanism and other reasons, which led to a lack of telecommunications regulators independence and authority, the trouble with contain the offense in telecommunications competition, un-effective protection to the interests of telecommunications users and other issues.Secondly, by means of the analysis of the content on legal system of telecommunications market supervision, the author found that many countries select a different regulatory approach according to their national economic and social development need, however, there are also some deep commonalities. From a practical development perspective, telecommunications regulators are developing from the dependency on government agency to independent of government agencies, the market access system is changeing from closed to open, the tariff regulation is changing from the single rate of return regulation combination to price cap regulation in diversification of ways, which have achieved good results. This is reflective of the deficiencies that exist in government telecommunications regulatory, and provides a reference experience on reform of the legal supervision of the telecommunication market. Finally, on the basis of summarizing the experience on telecommunication regulation of foreign countries, from the practical perspective of the changes in China's telecommunications market and business development, the author proposed that we should promot telecommunication industrial structure, strengthen the grade of service supervision, impel telecommunication services to popularize, impulse the advancement of telecommunication legislative work, take seriously to supervise the supervision organizations, reinforce supervises on organizations, and build a fair competition market environment to improve the legal system of telecommunication supervision. In this way, we can promote the healthy development of telecommunications enterprises with professional, effective and flexible regulatory measures, and safeguard the interests of telecommunications users. |
