Research On Contract Swindle Crime

With the vigorous development of China's market economy, the economic crimes also will be more rampant, and various forms of crime, contract swindle is one of the more common form. Because of the contract in their daily lives the high frequency of use. Therefore, criminals use the form of contract fraud occurrences. In judicial practice, the rapid growth of such crimes, and methods of crime are varied. So theorists of the crime of research and never stopped, the author will be do a more in-depth study in the basis of existing theory theorists contract fraud on some hot issues, and put forward some of the author own point of view.There is a dispute about the form of the contract in theorists. Some scholars think that the crime should include oral form of contract, but another do not think so. The author think that contract swindle should contains oral form. On the subjective aspects of contract swindle is quite fierce debate in theorists, hot spots mainly concentrated in "illegal occupation". There is a big challenge about the judicial determination and generation time of the contract swindle. The author will put forward some views on the basis of analysis of the existing theory. Form of objective performance of contract swindle is very complicated. So there are a lot of confusion in justice. The key issues focus on the definition between contract swindle and contract disputes or contract fraud, and the limit between contract swindle and similar criminal charge, the author will do a detailed analysis. This dissertation inquires into some of the major problems with the theories of the criminal law and judicial practice, so as to clearly analyze contract swindle and offer some help to future judicial practice.
