Since 1986 with a compensated system of land in China,the primary market of land in our country has different supplies,which not only make the primary market of land fall into chaos, but also make the connection between the scale of actual use of urban land with the long-term plan of city,annual plan and general plan for land use invalid. Especially with the rise of the real estate market in the middle of the 1990s, the negative consequences of the situation are prominent. In order to cope with the situation, the land storage system which aims at macro-control of land market is made. As a new land system in China, there are several problems during the process which are unable to avoid. On the basis of reviewing the development of land storage system at home and abroad, as well as defining the meaning, legal characteristics and functions of land storage system, this paper attempts to disclose the legal problems and make further thoughts and discussion in the view of the real estate regulation. This paper mainly includes four major parts:Firstly, after reviewing the developing history of land storage system, the author redefines the definition of land storage system, explains the operation mechanism of land storage system, as well as summarizes legal nature, legal character and function of land storage system.Secondly, the author analyzes the relationship between land storage system and regulation of real estate market. By analyzing the prominent problems of current real estate market in China through cases, the author tries to explain the influence of land storage system to the real estate market in four aspects: the supply of land, the supply price of land, the supply structure of land and the supply mode of land.Thirdly, the author discusses the current law status of land storage system in China, and points out the insufficiency of this current system in four aspects: the national legislation, the legislation system, the law application and the exact legal norms.Finally, the author offers his thoughts and suggestions to build up our land storage system. Based on feasibility study of uniform legislation for land storage system, the author suggests to include the land storage system in land management legislation in the form of State Council Regulations. At last, the author provides relevant thoughts and advices on the position-setting of land storage system, the application of public interests, the establishment of land storage institution, the perfection measures of land supply mode, the scope definition of land storage, the ownership change and management of storage land, and the financial management of land storage.
