The Reflection And Prospect Of The Law-Faith Crisis Of The Law-Executor

Faith is a topic which is more mentioned in all areas of modern society. The legal belief that a specific legal phenomenon directly determines whether the administrative law can be put into practice by the law-executor. Accordingly, the first part of this article would begin from the particularity of law-executor identity, and expounds the process of the analysis which the law faith is to be from its lack towards crisis in the of area of the administration. Meanwhile, the article would analyze in-deathly the characterization of the law-faith crisis of the law-executor in the law enforcement, and gradient explain the embedded concept.The second part is the core part of the article which analyzes the necessity of the crisis of faith of the law-executor. That the thirty years of reforming and opening up to China, brings opportunities and challenges to the development of legal. The traditional legal culture of China, which goes through the four-times shocks , that are the struggle of the law and ritual in the late Qing Dynasty, and the May 4th Movement, and the Cultural Revolution ,and then the Reform and Openness, had not existed lightly as a belief in the law, leaving only the specific legal system. This paper will be discusses in the four historical stages step by step. Probed into the more deep reasons, it also lies the factors of the local legal development process of fracture in China, and leading to political power structure unreasonable allocation, and also the law-executor's power being enlarged unlimitedly, while depressing the effective practices of the legal.In the third part, this paper will put forward in the reconstruction of law belief by two ways, namely thought patterns and mode of system. Thought patterns will establish the gradual mode of four stages, the master, respect, the fitting letter and the believing process to regain law-faith of the law-executor. Mode of system will be through specific system framework, namely the administrative procedure specification (the administrative participation, the government information publicity), public media supervision mechanism and administration accountability system, administrative education measures (administrative enforcement training, expert consultation), to remodel the law-faith of the law-executor, and gradually promote the inheritance of Chinese legal culture and the process of Chinese law developing.The fourth part will focuses on training the cultural elements of law-executor, through internalizing the spiritual core of Chinese law, and eternizing the legal knowledge of the law-executor, to set to Confucian rites were, relative to people-oriented administration and rule enforcement as the key link values to the law-executor. At the same time to absorb the service, integrity, process and other important concepts, and then, gradually to form a psychological suggestion, to improve the quality of law enforcement, to shape the character of the law-executor, finally, to achieve the Saint and Emperor of the realm, essentially due to overcome the cultural fault legal faith crisis, to train the law-executor, ultimately, to solute spiritual support of the development of China's administrative law issues, and then to build the harmonious administrative law in the socialism with Chinese characteristics under the rule of law.
