The Study On Legal Relief Of The Villagers' Self-governance

The villager autonomy is the basic form of practices in socialist democracy. As the core of the autonomy for villagers, the villagers'self-governance is the full reflection in the rural grassroots democratic life of millions of farmers'democratic rights in our country. However, because of the difference of interest orientation and argument, the phenomenon that the villagers' self-government is violated occurs frequently in the process of our country's villager autonomy system operation. In order to better realize and safeguard this villagers'important democratic right, the rational and feasible approaches about litigation relief must be offered to ensure the villagers' self-government.This paper demonstrates and researches from the empirical perspective and litigation relief of villagers' self-governance. The total paper divides into the following three parts.The first part: the summarize of the villagers' self-governance and litigation relief institution. This part mainly states the concept, character and content of villagers' self-governance ,and concept, characteristics and types of litigation relief, and analysis the urgency and necessity for the villagers' self-governance lawsuits relief from realistic perspective.The second part: The main problem of the villagers' self-governance litigation relief in our country. This part analysis the main problem of the villagers' self-government litigation relief starting from the actual cases. The author thinks that, at present the main problem of the villagers' self-government litigation relief in our country includes: the litigation subject and lawsuit type is not clear, the relief program is not standard, the responsibility is not explicit, the litigation procedure's intervention is difficult and so on.The three part: the suggestion to perfect the villagers' self-governance litigation relief in our country. This part in view of the main problem of the villagers' self-government litigation relief in our country, firstly analysis the selection of relief path shall conduct the villagers' self-governance is not a single right but a complex right bundle, so the relief should be from these following three paths: civil litigation, administrative litigation, criminal litigation; secondly respectively aims at the procedure of current civil, administrative and criminal litigation and puts forward some suggestions to perfect the villagers' self-governance litigation relief in our country.
