Duty crime is an ageless topic which is also reflected in the prevention of duty crime and legislation. As the last written statute under feudal system, the Great Qing legal Code( the Code) plays an important role in Chinese legal history and is worthy of deep research.Currently, there is no specific monograph depicting duty crime. This paper classifies and explores duty crime under the Code by borrowing theoryies from modern criminal law, expounding its application in judicial process.This paper is composed of introduction, main body and epilogue. The introduction mainly focuses on the relevant theories of duty crime, the value of this topic and research method.The main body is composed of 3 parts. Part 1 discusses the classification of duty crime under the Code. According to the Department of Code statutes and regulations, will be divided into six categories:first,by the spoils of crime;the second category,dereliction of duty;the third category,the criminal justice officials;fourth category,military officialscrime; fifthcategory, pseudo-crimial fraud;VI,in violation of system level crime. Part 2 expounds the contents of duty crime, its elements and penalty provisions. Part 3 explores its application and effects by detailing the fundamental reasons behind.Epilogue summarizes the problems mentioned there-above and the approach taken to further its research.
