New International E-commerce Risk Legal Precautions

E-commerce means that all the steps of the commerce become electronically. The E-commerce started and developed from 1970s, and it becomes the main form of the world economic activity. However, the development of E-commerce has many risks. There are too many studies on this subject, and this article will research the new risk of international E-commerce.This article use comparing analysis, rule analysis and history analysis method to study deeply the international new risk and the prevention of laws.Excepted introduction, the article includes four parts.The first part is the outlined of the article. This part defines the E-commerce from two aspects, and analysis the new risk and the prevention of laws in the international E-commerce.The second part tells the type of the new risk. There is new risk to operator and consumer from the joiner of the E-commerce. There also is new risk of the civil law, administration law and the criminal law. This part studies specially on the new view and whole angle, and think that resolving the problem needs depend on the economic and technical condition.The third part compares the prevention to the new risk. This part compares the international organization, abroad and our country prevention of laws. And it think that the UN, EU and OECD prevention of laws are too simple, the abroad prevention of law are perfect, and our country's are scarcity.The forth part improve our country prevention of laws, point out the idea of it, analysis the problem of contact law, work owner law, civil procedure law, consumer right pretension law and crime law, and suggest modifying the basic law, and analysis the condition of drawing up the E-commerce law and E-trade law. They are the method to improve our country prevention of laws.
