Analysis On The Consummation Of Criminal Protection For Trademark Rights In China

In the ages of knowledge-based economy, the manifestation of competition of economy finally is the competition of knowledge. The trademark rights as the important component of the intellectual property right, can promote the development of science and technology, raise the competition ability of economic. So in order to strengthen the competition of our country's economy, we must protect the trademark rights effectively. Among them, the criminal protection for trademark rights is one of the important parts. Now, the system of criminal protection for trademark rights has already formed in our country, and also has the function of protecting the trademark rights. Along with the development of economy, it appears some new situations which cannot regulate by the criminal law and the shortage of criminal law has appeared. So, perfecting the system of criminal protecting for trademark rights should be paid more attention.The thesis includes four parts to analyze how to complete the protection of trademark rights in criminal law.Part one, introduce two judicatory cases to extract the significance of the thesis: the criminal protection for trademark rights exist shortage and has to be improved.Part two, analyze the criminal rules for trademark rights to explain the scope of the criminal protection for trademark rights. The analysis on the shortage of criminal protects for trademark rights is the foundation to the next part.Part three, analyze the shortage of the criminal protection for trademark rights. In this part, combined with the cases of the first part we are going to put forward better suggestions of legislation.Part four, put forward the suggestions of legislation. In the base of analyzing the problem and the situation of legislation it proposed some suggestions of perfecting the criminal protection for trademark rights.
