Research Of The Criminal Victims' Protection In Our Country

As the world human rights developing, the movement of victim protection has been rising since the 20th century 60s and been got many countries'attention in the criminal field. The concept of human rights has been gradually rooted in people's heart since we wrote"the state respect and safeguard human rights"into the Constitution at 2004. The rights of the criminal suspect or defendant has been unprecedented respected and protected, in comparison, the victims'rights is hard to get effective protection, as well as it becomes central issue of academic research.Refer to some academic points of view and the legislation of victims'rights protection in other country, the author assumes some method to establish and consummate the system of victims'rights protection. The paper includes four parts:I. Overview of Victims'Rights Protection. First is introduction of the concept, feature and classification of criminal victims. Second is brief description of proper, legal, actual rights of criminal victims. At last, present the standard of victims'rights protection which established by United Nations.II. Current Situation of Victims'Rights Protection in other Countries. It'll introduce the status of victims'rights protection abroad and analyze it on aspect of litigation status, litigation right, compensation and legal aid.III. Current Situation of Victims'Rights Protection in our Country. China's Criminal Procedure Law has been amendment at 1996, since that it is ensured criminal victims is litigant, having rights during investigation, prosecution, trial and implementation. At the same time, it still exist some defect on proceedings, so it is necessary to know the significance of victims rights protection system.IV. Establishment of Victims Rights Protection System. The first is to improve the procedural rights of victims. The second is to extend the range and way of compensation request right. The third is to establish national compensation system. The fourth is to enlarge the relief manner of legal aid.
