On The Causes And Countermeasures Of Crimes Of Abducting And Trafficking People

The crime of abducting and trafficking people is an abominable kind of crime. Since the mid of 1990s, this kind of crime has been taking on some new features. However,our criminal legislation and judicial practice failed to make a efficient response to these new features which increases the difficulty of punishing the crime of abducting and selling people. Therefore,we should improve our criminal legislation and strengthen the cooperation of international criminal judicature,meanwhile,we should also improve our legal education. Only in this way,can we achieve a benign and steady development of our society.In addition to the preamble and the conclusion of this article is divided into four parts outside.Chapter one describes new features presented in the current crime of abducting and trafficking people. The proportion of gang crimes in trafficking crimes increases to a higher level. Targets of trafficking crimes are extended to adults males, but not only limited to women and children in the past. Meanwhile, the cases of trafficking hermaphrodite occur sometimes. Geographical expansion of crimes led to increase in the number of transnational trafficking crimes. Nowadays, abducted women and children, who are used to be sold to the lack of a wife or child's family in the past, not only are trafficked to pornography sites, but also are forced to fraud through all day long begging under the control of criminals. Moreover, some children even become organ market goods.Chapter two describes the hazard of the crime of abducting and trafficking people. The consequences of this crime are mainly reflected in physical and psychological harm suffered by victims, the great mental harm of victims'family members, social order is severely affected and social impact of basic ethical. Chapter three discusses the reasons of recurrence of the crime of abducting and trafficking people. Frequent occurrence of trafficking crimes is mainly due to the existence of a large buyer's market, cross-boundary characteristic of human trafficking crimes, legislative defects and weak legal impact in remote area.Chapter four presents the methods to curb the crime of abducting and trafficking people. First, improvement of the existing criminal law relating to punishment of the human trafficking crimes is necessary, and"crime of human trafficking"in the criminal code of 1979 should be restored to increase the penalty to buy one. Second, international communication, coordination and cooperation must be strengthened. Third, the law enforcement needs to be guaranteed. Finally, the public law awareness should be raised through enhancing the legal publicity and education.
