Research On The Reform Orientation Of China's Maritime Administrative Law Enforcement Regime

The 21 century is the century of ocean, many coastal countries have established the powerful marine law enforcement team and reformed the marine law enforcement regime to deal with the opportunities and challenges of the marine times, and establishing a comprehensive marine law enforcement regime is one of the development trends in the field of maritime law enforcement, which is the very essence of protecting national maritime interests, and preserving national maritime resource and environment. Currently, there are many problems in Organization of institutional settings and the construction of laws and regulations. Such as the right of Maritime law enforcement was carried out by many teams of administrative law enforcement at sea which belong to different divisions, which is a fragmented industry-style law enforcement system. With the development, the current law enforcement system has been unable to meet the marine ocean-century development needs, therefore, the current reform of the marine law enforcement system need to be reformed.In this paper, on the basis of the analysis the concepts of integrated ocean management and marine law enforcement, to define the the concept of marine law enforcement regime, simultaneously, to explain the foundation of integrated marine law enforcement through economics, management and law enforcement perspective. In chapter II, hopeing to learn from identify the current problems and the causes of these problems through the research of current status in marine law enforcement regime, and describes the importance of reforming the marine law enforcement regime. In chapter III, attempting to explore the useful references in the field of marine law enforcement from the United States, Japan and South Korea. And in chapter IV, We also analyze the possibility of China's current maritime law enforcement system reform and attempt to discuss the direction of the marine law enforcement system reform. And then, we put forward the reasonable suggestions for the ways which set out the unified comprehensive team of administrative law enforcement at sea, organizational settings and functions and tasks.
