Research On Security Obligations Of Operators In The Service Places

The basic task of operators is to ensure consumers of personal and property security in the service places. With the development of social economy, it corresponds to social danger increasing and consumers in the service places suffer economic or personal damage. The legal seevice site for operators to the security obligations without system regulation, in our civil law theory for the system research has just started, eventually in judicial judgment formed such cases in the existing situation of enormous differ. Considering the present situation, this paper firstly judicial respectively from different theories analyzes the operators' safety obligations legal basis; Thereafter, the specific provisions from our country law defines the operator on the legal nature of security obligations; Finally, in order to balance the needs of social interests, this paper puts forward the range of operator security obligations and the responsibility types. In order to help my theorists for operator security obligations of further research, in judicial practice to better help better judgment of similar cases.
