William Petty said" Nature is the mother of wealth and the father of labor". The rural land is the basis of our country agriculture development in China, it is the life safeguard of farmers in China, the land system is perfect or not and widespread a great relationship of peasant in China. The household contract management system was implemented Since 1978 and along with the inner and outer environment changes of our country agriculture development.The defects of the system of household contract management gradually highlight, it hindered farmers can be based on his contracted land forecast earnings of enhancement.It is also restricted the further development of rural economy, and restricted farmers to further improve productive earnings. In this context.1 want to base on reviewing of the founding of rural land property rights on the basis of institutional change, using the method of combining of qualitative analysis and quantitative analysis. Rural land as the carrier, take the perspective of fairness and efficiency to analysis the current China's rural land property rights system. Combined with the central committee of the communist party the twelfth planning about the rural land suggested relevant provision, constructing the path to solve problems of rural land property rights. This paper is follow to such ideas; it was divided into four parts.The first part:The changes of New China rural land property rights system.This part makes a brief review of the change of rural land property rights system since the founding of China. it was roughly divided into four stages of Rural land property rights system namely:Land reform, land collectivization, people's commune movement and household contract management system.This paper explores our country family contracted management of land property rights system.This stage was also divided into two phases, namely the establishment of household contract management system and implementing the contracted management of rural land circulation system. The second part:Fairness flaw of rural land property rights system. This part based on above a review of institutional change of rural land property rights Justice for perspective and analysis. It is not clear of the rural land ownership of current existing household contract management system.The right of management of rural land was irrational allocation contracted, the rural land expropriation and requisition income distribution belonging not perfect as for its innovationThe third part:The efficiency loss of Rural land property rights system.This section is also based on a review of the institutional change of first part of rural land property rights. Analysis concluded that the current family contracted management of rural land system exists against effective utilization of land contract With the efficiency for perspective, a short maturity of rural land circulation mechanism, contracted management of rural land wait for blemish.As for its analysis reasons of innovation.The fourth part:Unified the vision of fairness and efficiency to innovation of rural land property rights system.This part expounds in the process of the innovation of household contract management system in China,We should notice the principle of fairness and efficiency of dynamic relative reunification, then We analysis reasons on basis of the second and third part.We innovate our household contract management system from two aspects namely:reform the rural land ownership and contracted management of rural land.
