Study On The Perfection Of Classified Treatment System Of Prisoners

As we all know, classified treatment system of prisoners has lots of values, such as promoting implement of the criminal judicial concept of combining leniency with rigidity, increasing the positivity of prisoners'reform through labor, improving the quality of correction, preventing cross infection of prisoners and reducing the risk of surveillance, so we must build and perfect this system, to develop the prison-based-correction technique of our country and improve the prison- based-correction quality. However, restricted by factors of culture, politics and economy, our country has many shortages on the classification of prisoners, such as lack of legislation, inattentive standard of classification, chaotic classification procedure, lack of operability, deficiency of special classification organization, short of special classification talents, insufficiency of physical guarantee, imperfection of ancillary facility etc. To perfect the classified treatment system of prisoners of our country, firstly we should establish a proper correction concept, including drawing into the theory of restorative justice and individuality of execution, to ensure a classified treatment for different individuality; setting up the concept of humanization of execution, to guarantee related rights of prisoners; and constructing a correct game theory, to achieve a multi cooperative game. Regarding the detailed perfection of this system, firstly, we should establish a perfect standard of classified treatment, including clear the content of classified treatment and confirm a perfect and proper system of classified treatment. Secondly, we should set up a proper and strict procedure of classified treatment, including confirmation of start procedure, decision-making procedure, relief and supervision procedure of classified treatment system. Thirdly, we should perfect related supporting measures of classified treatment system, including improving the personal quality of classified treatment staffs and enhancing the hardware and ancillary facility construction of prisons.
