On Standards Of Arrest Proof

The design of China's arrest system is general and no specific quantified standards of arrest proof are in practice. It is necessary to improve China arrest proof standards by considering China's current practice and by learning from foreign countries' legislation and judicial experiences of arrest proof standards.The thesis consists of introduction, text and conclusion.The introduction starts from the significance of research in arrest proof standards and then introduces the theme to be discussed. Based on the research theme, the structure of the text is designed.The first chapter defines the concept of arrest proof standards and extracts the features. And it illustrates the significance of the improvement of arrest proof standards.The second chapter analyses the existing problems of arrest proof standards from the aspects of ambiguity, absence of proportionality, hierarchy and support of relevant matching systems.The third chapter employs the method of comparison analysis, making a comparison between legislation and judicial status of arrest proof standards between US, Britain, German and Japan and pointing out their redeeming features.The forth chapter proposes the design of improving China's arrest proof standards. Firstly it illustrates the principles which should be adhered to. Secondly it proposes to structure the arrest proof standards by employing dichotomy after giving consideration to the current practice. Lastly, to ensure the arrest proof standards function properly, the thesis makes assumption in the improvement of relevant matching systems to arrest proof standards.
