On Industry Associations

Since the eighties of last century, industry associations have seen significant development in the increasingly important role in society, which greatly promoted the economic development and social development. However, we must make it clear that there is still a gap between the development of industry associations and the requirement of the market economy ,the situation of which can be described as being not optimistic.There are also problems in the government level besides industry association's own reasons, for example, particular related legislation from the government can not keep up with regulations of industry associations. The author finds many serious problems existing in the exercise of disciplinary power during the dispute, including disputes not only between associations and members, but also between associations and the third party. There are a lot of disciplinary measures, including dismissal qualifications, market stands, fines, honorary disciplinary and so forth, some of which are very severe for offenders, and some have direct damage to the lives and opportunities for offender's freedom. But we still a long way to go.The author conducted useful discussions for the relief mechanism.The source of disciplinary power should be considered firstly, including legal authority,the Government commissioned and the contract assignment, and the corresponding relief channels including executive Lawsuit,arbitration,mediation mechanism,and then analyse the feasibility of the various relief channel.
