On The Legal Problems Of International Factoring

In the 1960s, The letter of credit has been the dominant means of payment in international financial and trade fields, but now, collection, remittance, The letter of credit and international factoring are equally important in international financial and trade fields. In recent years, with more and more using of international factoring in China, and with the increasing number of international factoring cases, some international law experts are studying the international factoring carefully. The professor Huang Bin is one of typical representatives in this field, and his theories are my theoretical support and sources.This article is composed of four chapters.The first chapter starts from the legal base of international factoring, explored the basic legal mechanism of international factoring, and the every part in the issues of international factoring cases.In the second chapter, it is started on the base of chapter one. it includes many legal risks encountered by the every part in the issues of international factoring cases.In the third chapter, it mainly talks about the international law sources of international factoring. The sources are international treaties and international practice.The fourth chapter is the main contents and innovative part. It is composed of legal problems and corresponding methods of solving these problems. The more important details are the new kinds of international factoring.
