The Judicial Review Standards Of The Licensing Registration

Licensing registration represented by the enterprise establishing registration is not only a common administrative action, but also an important way for the administrative authorities to manage the social affairs;Generally, as a code of conduct, registration is used in social life and regulates the social order. The registration action which is completely conforming to the laws and regulations of the registration condition is ideal; however, the fact always goes to opposite. When the conflicts of registering happen, licensing registration would access to the justice perspective, and then the court must establish the principles, standards and rules of the cases so as to explain the jurisprudence of the registration system.On the one hand, it can lead the registering organizations to execute their duties; on the other hand, it can also guide the commons to solve the problems effectively, as a result, to protect their rights and maintain the registering order.This paper starts from the purpose of the judicial review and tries to establish the standards reasonably, so as to protect the interests of counterparts.In the beginning, the author tried to explain the reason of the subject selecting, and then gave a brief introduction of the licensing registration's concept, the review mode and the purpose of the judicial review. Afterwards, it discussed the review standards of the licensing registration from the facts and law aspects. At last, it gave a necessary analysis about the protection of the people's right and the responsibility of the registering organizations.
