Research Dissertation Dissemination Of Intellectual Property Issues

With the development of internet and information technology, E-books and the cause of digital library is developing. As the sources of the digital library, dissertations have some unique characteristics, such as large quantity, high research value and grey character, those are the reasons why protect the dissertations'intellectual property is very difficult. Too many lawsuits against dissertations copyright by the thousands of masters and doctors made us have to ponder. Why there are many people suit dissertations copyright? Which prevents the digital library from getting the copyright authorization legally and conveniently? What kind of copyright authorization model can protect the copyright of the authors, at the same time promote the development of scientific culture? Considering the thinking on the problems mentioned above, this paper makes an analysis on the intellectual property of dissertation in the spreading process by using the methods of literature research, questionnaire, cases analysis, comprehensive analysis and citation analysis, and analysis the tort reasons and copyright collective authorization modes, on those bases propose the viewpoints of the author.This paper consists of six parts. The first part is exordium. The author introduces the present research situation of digital library intellectual property from domestic and abroad, and research values, research methods and research goals. The second part introduces the ownership of the copyright of the dissertation. The third part introduces the two propagation channels of dissertation from the aspects of conventional and network and analysis the risks of intellectual property tort. The forth part makes an analysis on the reasons of dissertation tort risks. The fifth part proposes the viewpoints of how to protect the dissertation's intellectual property from infringement. And in the finial part analysis the four modes of dissertation's copyright collective management in China. At the same time, points out the advantages and disadvantages in each model and proposes the good idea to resolve the dissertation's mass authorization.
