The Study On The Effects Of Malfeasance

Along with malpractice crime increasing, more and more jurists concerns that how to understand the harm results which is the difficult problem of dealing with the case. This paper discussed from three aspects. Firstly, the author analyses the meaning and characteristics of malfeasance harm results. Secondly, the author classifies malfeasance harm results into the physical harm result and non-material harm result. The author thinks in judicial practice material result has some drawbacks just as the standard of casualties amount is too high to practice. To the argument of non-material harm result, the author thinks that it should establish a set of professional organizations to evaluate the result of non-material harm result. So the standard of casualties amount should be connected with local income and should reduce the requirements of people casualties. At last, the author discusses the problem from four aspects:direct harm result, indirect harm result, illegal income and reducing harm result. The author thinks that conviction of malfeasance should consider not only the damage amount but also the results of action.
