The Tort Liability Of News Media Infringing The Right Of Reputation Of Public Figures

The dissertation mainly analyzes the particularity of tort liability of news media infringing the right of reputation of public figures. In part one of these dissertations, the author analyzes the conception of public figures and its categories. The reason why the author did this is that such conception as "Public figures" is not yet introduces in all departments of law of our country, so it is necessary for author to briefly introduce this conception at the beginning of the dissertation. At the same time, as the reputation of public figures is the central object discussed in this dissertation, the author must further expounds the connotation and features of the reputation of public figures on the foundation of discussion on the basic conception of public figures, the division of the types of public figures, and its legal significance.In part two of the article, the author must commence on the relationship between the right of news freedom and right of reputation of public figures. In the analysis of this article, the author explains the internal relations between news freedom right and public figures' reputation right, so as to makes transition to the central thesis of the article, namely, the tort liability of news media infringing the right of reputation of public figures.The core subjects of the dissertation are Part three, Part four, and Part five. On the basic foreshadowing discussion of Part one and Part two, it mainly discussing the particularity of the tort liability of news media infringing the right of reputation of public figures in these three parts. Firstly, the author taking the legal system of more developed America in Anglo-American law as example introduces the differentiated stipulations of American torts of the constitutive requirements of the tort liabilities of news media infringing the right of reputation of public figures and of common people in Part three of this dissertation. In demonstration of cases, then the author illustratesspecific application of the constitutive requirements of the tort liabilities of news media infringing the right of reputation of public figures in China.In Part four, the author talks about the plea instance of the tort liabilities of news media infringing the right of reputation of public figures. Just as the frame of Part three, the author firstly explains specific stipulations of the plea instance of the tort liabilities of news media infringing the right of reputation in western developed countries'laws such as America. Then, the author discusses the specific views on the plea instance of the tort liabilities of Chinese news media infringing the right of reputation of public figures.At last, the author analyzes what specific legal responsibility form should the news media bear for their infringement of the reputation right of public figures. Then, According to China's current about infringement of civil law in many liability form specific violation news media in public figures in reputation infringement liability to apply. It should supports the basic demands of the reputation of public figures, and protects full freedom of media, lei it criticizes and supervises public figures, thus balancing the social interests. So, the author advocates for more practical liability forms of news media infringing the right of reputation of public figures of civil laws and regulations should be stipulated, and more specific stipulations on the modes and degrees of bearing legal responsibility.
