The Research On The Demolition Compensation Problems About Chinese Collective Land

Rural house demolition is an inevitable problem for government in our country. Because rural house demolition compensation system is imperfect and the parties are easily influenced by economic factors, demolition work is hard to carry on. In order to complete demolition work timely and efficiently, illegal removal and violent demolition appear. Compared with the real estate company and the government, the dismantles are disadvantage groups. The dismantler often infringe upon the lawful rights and interests of the dismantles during the process of demolition, which give rise to mass incidents and influence social harmony and stability. All of these problems are due to the inconformity between the laws and regulations. So it is necessary to make an investigation about rural house demolition.This research mainly adopts two ways:visit and questionnaire. First, we get thorough understanding about investigation contents and the dismantles through face-to-face conversation. I listen to the views and ideas of farmers about the dismantlement and compensation. Besides, I visited the Housing Units Management Board of county Qi during the investigation to know relevant policy and have a full discussion with the court of county Qi about applying of law. Second, I get investigation results throng online surveys.This paper is divided into four parts. The first part is the significance of the research, which mainly introduces the purpose of this investigation. The second part makes a brief introduction about the basic situation of the investigation. The third part introduces the problems showing up in the research and the reasons, etc. The fourth part is measures to solve the problem put forward in the third part.At present, we don't have a specific law to regulate rural house demolition, which cause demolition work chaos, assessment work imperfect, the dismantlees interests impaired. In order to protect the interests of the dismantlees, we must improve the corresponding laws and regulations. We shall make clear about the standard, the scope and the procedure of the dismantlement compensation through law and regulations. Meanwhile, the conditions to realize the assessment and demolition shall also be prescribed down. In order to make the whole demolition work going well will be good for interests of both parties.The paper summarizes the problems in demolition work and analyzes the reasons of these problems in investigation report. Besides, this article introduces the present situation of rural house demolition and proposes some concrete suggestions for these problems. County Qi is constructing roads, factories etc, which will demolish a large number of buildings. That is to say, rural house demolition work of County Qi is just starting. It is inevitable to encounter some problems, which will involve some legal issues. Through this research, the author puts forward what problems existing in the process of rural house demolition and analyzes the reasons. We hope the government and the related departments attach importance to rural house demolition and work these problems out.
