Begging, as a social problem, has been aroused the attentions in many countries, especially nowadays, the phenomenon of organizing disable men and children to beg increased in a high proportion. These social problems are not only harmful for disables and children's freedom and psychological health, but also adverse to the society solidity and harmonious. Thus, article 17 of Amendment VI to Criminal Law of the People's Republic of China established relevant regulation on begging. The legislation on the crime of organizing disables and children for begging is favorable for the protection of the disables and children's legal rights. However, there are also some defects in the law.This paper is consisted of six chapters. Chapter I mainly analyses the definition of the crime of organizing disables and children for begging, and introduces the legislation background and social value.Chapter II discusses the object elements of this crime from the angle of new crime constitutes system, such as the behavior, the activities, and the objects.Chapter III mainly analyses the responsibility and gilt types from the angle of subject responsible element.Chapter IV mainly discusses the crime forms, including the unfinished form, complicity form, and crime from which is the focus of the analysis.Chapter V proposes the theory support for the crime justice identify. The chapter mainly defines the constitute elements of the crime, and takes many special cases to support the study.Chapter VI mainly discusses the defects in legislation and proposed the ways to improve.
