Research On The Question Of The School's Responsibility Of Student Injury Accidents

Student's injury are accident which happens in school where they organize activities or school activities or do these out of school, dormitories, and which cause student personal injury for which the school should be held accountable responsibility. With the growth of student injuries, injury accident on students accountability is quickly becoming the focus of the community questions. The legal provisions on student's injury are very complex and confusing, which make it difficult to handle the case in practice, and it is also suspected of increasing the school's responsibility. I think these provisions are not benefit to the normal development of the school education. The provisions of student's injury responsibility principle and supplementary responsibility are all need to improve. School tort liability insurance system of school accountability is the best solutions.This article consists of three parts:The first part, overview of the student's injury. The paper expounds the concept of student injury, the type and to explore the nature of the school responsibility. Article lists some kinds of theory to point out their defect and the author accords to lay the foundation for the next study.The second part, the problems of the school responsibility's law provisions and how to improve. This article primarily discuss two aspects. One is responsibility provisions, the other one is supplementary responsibility. The most important is I proposed many recommendations.The third part, to establish the tort liability insurance system is the most appropriate way to tackle the school's tort responsibility problems. In this paper, the author describes the establishment of the school system of tort liability insurance is necessary and important, and also express that the current system of school's liability insurance has some problems, finally, I proposed many practical recommendations to improve it.The innovation of this article is: The standard of distinguishly applies to different responsibility principle should be comprehensive, such as the students'age, the school's attention obligations, and so on. Only in this way, we can avoid unfair treatment. My article also redefine the school's supplementary responsibility. Finally, I proposed recommendations to the school tort liability system.
