Empirical Research Of Acquittal

Since the restoration and the reconstruction of the procuratorial organ in 1978, the acquittals of the cases of public prosecution have attracted high attention. Considering the constitutional position of the People's Procuratorate, the nature of its legal superintendence and its role in criminal lawsuit, it is reasonable to pursue the successful rate of public prosecutions and the conviction rate of the accused person. Based on the Procuratorate of Y City, this article has reviewed the acquittals and the cyclical changes of the procuratorial organ since its restoration and reconstruction, introduced the legal ground and the types of acquittals, and investigated the underlying factors that resulted in the acquittals. The author also has analyzed the factors that would affect the prosecutor and the public's attitudes towards the acquittals and has argued the rationality of the existence of few acquittals and the proper control of the acquittal rates. And eventually expected to build up the latitude towards acquittals in a rational manner.
