With the deepening development of the global economy, the issue of environmental protection has aroused widespread concern. On February 25, 2011 Criminal Law Amendment (viii) has made major changes to the crime of major environmental pollution accident, the constitutional elements of which, the results of the crime, has been changed from "causing major environmental pollution accident, resulting in heavy losses to serious consequences like public and private property or personal injury " to "causing serious environmental pollution "; material of the discharge, dumping or disposal has been changed from "hazardous waste" to "hazardous substances" and the requirement of emissions, dumping or disposal " to the land, water, air" has been deleted.Except the introduction, epilogue, including the four parts, the first major change described major environmental pollution accident before the object of different interpretations of the crime, the crime of major environmental pollution accident, the doctrine of Criminal Law and the amendment of the crime of serious environmental pollution accident benefits against the law amendment. The second part describes the amendment to the crime of serious environmental pollution accident, and major amendments of conditions of environmental pollution accidents judicial determination of conditions of the crime. But this amendment to Criminal Law has still left some problems in the judicial application of the crime of major environmental pollution accident.
