The judicial administrative power is the important component of the state power. As a comprehensive power, the judicial administrative power is different from simple judicial power and also is different from pure administrative power, but have judicial attribute and administrative attribute both. It originated in the refinement and specialization division of judicial power. It takes the normal operation of judicial power for core functions. With the development of society, the connotation of the judicial administrative power is expanding constantly. The judicial administrative power has the functions of legal services for society and the government gradually. Currently, China's judicial system reform is in the deepening stage. The research of the judicial administrative power is not only the need of the development of the reform of the judicial system, but also the rational needs.The first part of this thesis analyzes the concept and characteristics and functions and allocation principle and basic theory of independent existence of the judicial administrative power. Part two introduces the judicial administrative power of foreign countries. Several representative configuration mode of the judicial administrative power and the general functions of the judicial administrative organs are discussed. The third part analyzes the development history of the judicial administrative power of China and points out the reforming reasons of the judicial administrative power. Part four points out the problems of the judicial administrative power of our country from the configuration characteristics of the judicial administrative power. The fifth part is about the perfect of our country's judicial administrative power allocation. Improving the judicial administrative power allocation must be based on our constitutional system.
