On The Construction Of China's Anti-monopoly Law Enforcement Agencies

Along with anti—monopoly law promulgating and implementing,we have gained much achievement in our anti—monopoly job.However,we found that the anti—monopoly job had not fulfilled up to expectation.There are many reasons.But the main reason is that there are some problems in our anti—monopoly enforcement institutions which contain anti—monopoly institutions and anti—monopoly committee.For example, it's obscure that what's the nature of the anti-monopoly committee;the provisions of the anti—monopoly law didn't formulate enforcement institutions clearly;the duties of anti—monopoly law enforcement institutions are not formulaed clearly,meanwhile,anti—monopoly law didn't formulate that the anti—monopoly law enforcement institutions is the creation of a new institution,or which of the existing institutions;it's uncertain that whether the anti—monopoly law enforcement institutions have judical power;How to stucture the framework of anti—monopoly law enforcement institutions,especially the level and efficiency of enforcement is up to the staffs of institutions.Therefore,it's urgent to improve the exsisting anti—monopoly institutions.For our country,we should consider ourselves'country situation on base of experience of other countries.Also,we should keep priciples of structuring the anti—monopoly institutions.And then,we should clarify relationships between the anti—monopoly institutions and other institutions.Finally,this paper will concept the authorities of the anti—monopoly institutions to fide a right way.
