A Outsider Raises Objections V. System Research

The relief system of civilian implementation is an important part of the civil law system. The system of the outer party dissidence lawsuit is a kind of substantive relief system. It plays a great role in protecting the legal rights of the outer party, restricting executive power and maintaining justice. Our country has established the system of the outer party dissidence lawsuit in the latest civil procedural law amendment, but there are still many defects in it. In this thesis, firstly I describe the basic theory of this system, such as the meaning, characteristics and nature of this system, and distinguish this system with relevant systems. Secondly, I studied this system of several typical continental law system countries or regions in order to provide references for perfecting our legislation. Thirdly, I discuss the status of this system in China civil procedure law, point its progress and analyze its shortcomings mainly. Lastly, I put forward some suggestion to perfect this system.
