Criminal reconciliation is a new method of criminal dispute exploration solution,the criminal reconciliation adopted by our country was inspired by western.Restorative Justice but different from it at the same time.As absorpting high degree of democracy and comprehensive restoration of Western Restorative Justice,how to get full implementation in our criminal reconciliation,there is not just differences between the theoretical conceptions to be resolved,more important is to explore a more reasonable and feasible model construction based on the comparion of the similarities and differences between the existing models,to define the position,remove the obstacles,clarify the effect,make the operation specific and construct the series of supporting measures in the system,to make it integrate into the existing criminal justice system,to assist our criminal disputes get diversely resolved.This paper proposes the concept definition of the criminal reconciliation and analysis its elements firstly,then discuss the similarities and differences between the criminal reconciliation with restorative justice,plea bargaining and compounding,explaine the multi-disciplinary theory solid to explore our criminal reconciliation,comparative analysis the four criminal settlement patterns overseas,compile our existing system to explore the criminal settlement,expound the views of existing exploration then preferred model is proposed.Based the lessons learned in criminal settlement at home and abroad,get the three basic questions in the proper implementation of criminal settlement exploration and draw the recommendations of the criminal settlement system construction.Finally,to investigate the specific operation of the typical pattern of criminal settlement presided over the prosecution,get the institutional framework of criminal reconciliation in all aspects as the rights and obligations of the main staff in procedures,the program's start,the program's preparation and implementation and relief and complete supporting measures to procedures.
