China's Private Detective Study

In the recent years, the industry of private detective is booming and growing worldwide. In today's western countries,the detective has become an occupation just like attorney or doctor.They use their own specialized knowledge and the special skill to provide all kinds of services for the society. Our country law expressly forbid private detective, however, with the development of market economy and social division of labor, diversified private detective in China began to appear for people place more and more attention. Our private detective business is the emergence of the economy the inevitable result of social development, the private detective go today, its rationality has become inevitable, therefore, the private detective business focus should be transferred to standardize management up. Based on the current legislation system, the author attempts to it clearly legal position, to distinguish procuratorial and DiaoZhaQuan from right nature, exercising mode, function and the conception of Angle, a concrete analysis, and combined with the situation of our country, the reference other countries'legislative experience, constructs corresponding legal system, on legal framework for detective business for timing adjustment, reasonable restriction and the right guidance, make the disadvantages, healthy and standardizing development, so as to better impel our judicial system reform and the construction of democratic law system, promote the further improvement of rule of law of harmonious society.
