The Realization Of The Path Of Judicial Independence With Chinese Characteristics

In 2002,it was determined that "guaranteeing fairness and justice in the whole society" overall target and direction in the report on the Sixteenth Seventeenth National Congress of the CPC.In 2007, in the report on the Seventeenth National Congress of the CPC, higher demands was set forth,with insisting on the development path of socialist politics with Chinese characteristics, further deepening reforms in the judicial system,and building judicial, highly efficient and authoritative socialist judicial system. By the end of 2008, the Central Committee of the Party had formulated " concerning the issues of deepening the reforms of the judicial system and working mechanism ".To achieve the above goals we need to establish the independent system of judiciary.Both in theory and in fact, the decentralization is not the only basis for judicial independence, for non-decentralized countries can engage in an independent judiciary. Whether in the judicial developed country or undeveloped countries, and no matter under what kind of ideology, judicial independence has become the basic requirements of the various political systems. There is not super-political judicial independence in the world, judiciary has always serviced for politics. Independent system of judiciary is a useful mode of operation of state power,which could certainly provide the great masses with more just, equitable and effective judicial service.
