Theft Objective Research

As the first crime of property crime, larceny is always caught the most attention of the criminal scholars. Amendment 8 to the Criminal Law of the Peoples Republic of China amends the contents of larceny. The paper focuses on the larceny which is included in the amendment. Except the preface and the end, the paper is divided into 3 chapters.The first chapter probe deeply into the objective aspect of larceny, including larcenous amount and "steal many times", which are always the important standard to conviction. The chapter mainly discuss "secret steal", "large amount", "steal many times" by combining different theories with legislation. Meanwhile, this chapter also analyzes the relationship between "large amount" and "steal many times" in conviction.According to the amendment 8 to the Criminal Law of the Peoples Republic of China, the second chapter concentrates on indoor theft. First, combing theories of robbery of housebreaking and legislation, this chapter researches the concept of household. Second, it analyzes several special case of household. Besides this, this chapter also researches the concept of robbery of housebreaking, and makes detail introduction of types and intention of robbery of housebreaking. Third, this chapter gives high evaluation to the draft for the dangerous and high frequency of indoor theft.According to the amendment 8 to the Criminal Law of the Peoples Republic of China, the third chapter analyzes the content of stealing bearing lethal weapon. This chapter discusses the taking and weapon by introducing theories and law descriptions firstly. Secondly, it explain several special issue of stealing baring lethal weapons in order to further explain what is the deep meaning of stealing baring lethal weapons. Last, it gives positive evaluation to Draft of amendment 8 to the Criminal Law of the Peoples Republic of China for it contain stealing bearing lethal weapon as a crime which repel large mount.
