False Civil Action Research

Current society, credibility is missing. The civil lawsuit, one of the important methods of maintenance citizens' legitimate rights also faces credibility crisis, there appeared a disharmonious phenomena, that is false civil lawsuit. So-called false civil lawsuit namely not has substantial controversial civil action which the parties malicious manufactured in order to achieve some illegal purpose, False civil lawsuit damages the civil litigation embodies judicial justice idea, endanger the credibility of the authoritative, the harm is visible.The first part of this text discussed the concept, the characteristic of the false civil lawsuit from the analysis of its connotation. Then the author systematically studied its type and qualitative problem. In the second part of this article, from the china's present situation of civil lawsuit we focuses on analyzing the causes and social harmfulness of false civil lawsuit, namely where false civil litigation has come, what is the reality harmfulness of it. In the third part of this article we studied on how to regulate the false civil lawsuit. We do analysis from two aspects of the legislation perfection in order to improve the illegal cost and reform judicial internal mechanism to strengthen coping ability, how to regulate is the key research. Furthermore, related system of regulation false civil lawsuit are also analyzed in this paper.
