In the past, the cooperation between copyright protection system and technology is basically harmonious, but after entering the Internet era, here comes the challenges and crisis. The Internet right now is extending the private self- copying abilities, and at the same time, connecting the individual consumers who used to be scattered. The huge consumer groups have formed a dominant disseminator which by passed the previous copyright system pattern to duplicate and exchange the information directly. Combining with the developments of the Internet tech itself, the cyber law has greatly strengthened the control of people's creativity. People can only do their creative jobs after being permitted by the original authors or founders. But the essence of the Internet is based on the sense of exchanging and recreating the works of other people freely, it's about opening to public use and sharing new ideas. So when the rules are overused, the Internet spirit might be suffocated. At this time, a movement which is called the"Creative Commons"is springing up all around the world. it advocates the existing legal framework, using the Internet technology, trying to overcome the deficiencies of the traditional copyright protection system. By offering a series of special license agreements to the public, it showed us a more flexible and efficient way to protect the creative achievements. In this article, we'll talk about the Creative Commons which is originated by professor Lawrence Lessig from Stanford University, law school, and the general theories of the copyright law. I will review a bit about the backgrounds, the reasons and concrete operations of the Creative Commons. I will also offer my ideas on the advantages and disadvantages of the copyright law in the Internet era by means of the common foundations of the Creative Commons and the existing rules. In chapter four, I analyzed the localization of the Creative Commons in China, including the development of CC license agreement in China. From CC2.5 to CC3.0.
